[The President]… in Case of Disagreement between [the two houses], with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper…
Since the House and the Senate now disagree with respect to their time of adjournment for the August recess, Obama needs to adjourn both houses until the Tuesday after Labor Day--and then fill every single unfilled appointment in the executive branch with a recess appointment.
He won't, of course.
